News posted by www.newsinfoline.com

The National Green Tribunal provides for the setting up of specialized environment courts. They are given the powers to hear original cases as well as appeals on cases from authorities under various environmental laws. The Bill replaces the existing National Environment Appellate Authority. The Tribunal would hear cases on 'substantial questions' relating to the environment including those that: (a) affect the community at large, and not just individuals or groups of individuals, or (b) cause significant damage to the environment and property, or (c) cause harm to public health which is broadly measurable. The Tribunal is to have benches at five locations. There is a procedure for direct appeal to the Supreme Court from the judgment of the Tribunal.
