New Delhi, May 10 (PTI) A Delhi court today awarded rigorous life imprisonment to man for bludgeoning to death his estranged wife with a cricket bat in 2004 here as he had suspected her fidelity. Additional Sessions Judge Arun Kumar Arya, however, rejected the plea of the prosecution that the convict be sent to the gallows as the "heinous" offence was was committed in a "brutal manner". "It is on record that convict Satish Gupta is around 50 years of age and the manner of killing the victim cannot be said to be brutal . mitigating circumstances are significant in comparison to aggravating circumstances. His sons had not left him but are regularly attending court and also requested for a lenient view," the court said, justifying the award of the life sentence. It also imposed a fine of Rs 2,000 on convict Gupta, a resident of Sangam Vihar here, under section 302 (murder) of the IPC. Gupta, who was living separately from his estranged wife and four sons, was arrested on the morning of December 2, 2004, after he himself informed the police about the incident and also confessed his guilt. In his statement to police, he said he killed victim Sarvesh by hitting her 11 times with a cricket bat as she was of "loose morals". The investigators also recovered the bat at his instance, the court said. The court rejected the plea of the accused that he was framed and arrested when he had gone to the police station to inform about the death of his wife. "The defence has failed to assign any plausible or cogent reason of the false implication of the accused. Moreover, the accused did not give reply as to why he was falsely implicated.," it said. The court did not give weightage to the testimonies of the sons of the accused who gave clean chit to their father and said robbery was the motive behind the murder.
