Twins born to a gay Israeli couple through a surrogate mother in Mumbai have been denied permission to enter Israel after a Jerusalem family court refused to permit the father to proceed with a paternity test. The court's refusal to give permission for the test to Dan Goldberg (42) has come in the way of the children obtaining Israeli citizenship.Consequently, Goldberg and the twins have been stranded in Mumbai for two months now. Israeli laws stipulate a paternity test for the infants to get Israeli citizenship but the court has said that the matter is outside its jurisdiction.After two failed attempts at in vitro fertilisation in India, Goldberg finally became a surrogate father of twin boys Itai and Liron two months ago. Sources said that Goldberg and the twins have been at a Mumbai hotel since, awaiting permission from the Jerusalem Family Court to proceed with the test.This is not the first case of a gay couple from Israel seeking a surrogate child in India and family courts have issued decrees stipulating a DNA test.In 2007, an Israeli couple - Yonatan and Omar Gher - had their baby in India and are now back in Israel.A source close to the father said, "The judge is orthodox and has not accepted Goldberg and his partner as a couple and hence denied permission to allow the paternity test (a pre-requisite for the children's naturalisation as Israeli citizens) in Israeli medical centers. Goldberg can appeal to a higher court to allow the paternity test. Goldberg's contention is that if gay couples in the past were allowed why not him?" Dr Anita Soni, an obstetrician with L H Hiranandani Hospital in Powai who took care of the surrogate mother in this case, said, "Everybody has a life and let them live their own life. Every person is entitled to have a baby."
