Tiwari: SC sends paternity suit back to trial judge

The Supreme Court on Monday referred the paternity suit involving former Andhra Pradesh governor N D Tiwari back to the trial judge for framing issues without any prejudice caused by observations made by courts earlier. It also said an application, if made for an in-camera hearing, might be considered by the trial court. Tiwari had approached the SC for a stay of an April 7, 2010, order of the Delhi HC, which asked him to explain as to why he was averse to a DNA test in order to ascertain if the allegation raised by 31-year-old Rohit Shekhar about his paternity was true. The High Court had also directed Tiwari to file a "specific" response on 100 photographs on record featuring Tiwari with Rohit Shekhar and his mother.Senior advocate Harish Salve, appearing for Tiwari who had to quit his gubernatorial status after a regional channel aired a video allegedly showing him in bed with three women in December 2009, sought "protection" from a three-judge Bench headed by Chief Justice of India K G Balakrishnan.
